Coach hire terms and conditions
General contract and travel conditions for coach hire and group travel
These general contract and travel conditions govern the legal relationship between you and EUROBUS and form an integral part of your group travel agreement with the operator. Special provisions in the agreement between the customer and EUROBUS take precedence over these general contract and travel conditions.
12.
Liability – general
EUROBUS will reimburse you the value of agreed services that were not provided, insofar as it was not possible for the operator to provide an equivalent replacement service.
EUROBUS is a member of the Swiss Travel Industry Guarantee Fund. We meet the requirements set by the foundation with regard to professional competence and solvency.
12.1 Material and financial damage
The liability of EUROBUS for material and financial damage resulting from the non-performance or improper performance of the contract is limited to a maximum of twice the price of the trip, unless the damage was caused intentionally or through gross negligence. If the damage was caused by other service providers, EUROBUS has the sole right of recourse against them. We accept no liability for valuables. Outside the contract, we are only liable for material and financial damage in cases of gross negligence or intent.
12.2 Personal injury, accidents, etc.:
We are only liable for personal injury, death, bodily harm, etc. resulting from the non-performance or improper performance of the contract if we or a service provider caused the damage intentionally or through gross negligence. The limitations and exclusions of liability in international agreements and national laws remain reserved (clause 11.2.1). Use of the car parks is at your own risk.
12.3 Exclusions of liability
EUROBUS is not liable to you if the non-performance or improper performance of the contract or the damage is attributable to the following causes:
a) failures on your part before or during the trip;
b) unforeseeable or unavoidable failures of a third party not involved in providing the contractually agreed service;
c) force majeure or an event that EUROBUS, the agent or the service provider could not foresee or avert despite exercising due care. In these cases, any liability of EUROBUS for damages is excluded.
12.4 Events during the trip
12.4.1 Liability for third-party services:
Outside the agreed travel programme, local events or excursions may be booked during the trip under certain circumstances. It cannot be ruled out that such events and excursions involve risks. These events and excursions are not offered by us, and it is your own responsibility whether you take part in them. We are not liable for the correct performance of such contracts. Please note that third-party providers may not observe the EUROBUS safety standards. EUROBUS gives no guarantee for the services of third parties, and the customer alone is responsible for checking the provider, its employees and the equipment. This exclusion applies in particular to all risky activities, such as bungee jumping, undertaken by the customer or members of the customer’s travel group during the trip.
12.4.2 Treatments, beauty weeks, etc.:
Medical treatments are subject to medical supervision; beauty treatments are carried out under the supervision of specialists. We merely arrange these offers for you and therefore cannot vouch for the doctors, specialists, their assistants or the success of the treatment, or assume any other liability.
12.4.3 Safety on cycling and hiking tours:
You practise your sport at your own risk. Good health is a prerequisite for participation. If a participant does not meet this requirement, the tour guide is entitled to refuse their participation in the hikes or cycling tours. The price paid for the trip will not be refunded. You are responsible for complying with the road traffic regulations of the country concerned, even when travelling with a group.
13.
Applicable law and place of jurisdiction
