Coach hire terms and conditions

General contract and travel conditions for coach hire and group travel

These general contract and travel conditions govern the legal relationship between you and EUROBUS and form an integral part of your group travel agreement with the operator. Special provisions in the agreement between the customer and EUROBUS take precedence over these general contract and travel conditions.

1.

Subject matter of the contract

The operator undertakes to provide the requested service in accordance with the tender and/or the order confirmation. The customer shall bear any additional costs arising from additional services.

2.

Quote

We charge the following fees for preparing your quote:

2.1 Quotes for charter coaches without third-party services

Free of charge

2.2 Downloading standard offers from our website or obtaining standard offers from one of our consultants

Free of charge

2.3* Provisional reservation for package offers

* CHF 100.–

* The provisional reservation fee will be credited to you upon a definitive booking. All services and dates are subject to availability. The option period for a provisional reservation is 14 days unless otherwise agreed. If you do not make a definitive booking by the end of this period, your entitlement to the services and to a refund of the option fee lapses.

3.

Booking

You can make your booking in writing, by phone or in person. The contract between you and EUROBUS is concluded with your service order, i.e. upon acceptance of the quote. An order sent by email is also legally valid.

4.

Prices

The prices are shown in the tender or the quote. Please note the section “Services included”.

4.1 Driver expenses

The driver’s meal and accommodation expenses (single room with shower/WC) are borne by the client.

As a rule, however, they are covered by the host hotelier or restaurateur for groups of 20 or more participants; otherwise, the following rates will be charged: meal: CHF 25.–, overnight stay: CHF 150.–

4.2 Night surcharges

For night-time assignments between 9 pm and 6 am or until the coach is released, we charge a night surcharge of CHF 50.– per hour (unless otherwise stated in the quote/order confirmation).

4.3 Additional hours

If the driver’s assignment extends beyond the period stated in the order confirmation, we charge CHF 90.– per additional hour.

4.4 Gratuities

Gratuities for drivers are not included in the package price. If you have been well looked after, you are welcome to thank our drivers with a tip.

4.5 Heavy vehicle charge (PSVA)/road charges/fuel surcharge

The flat-rate heavy vehicle charge (PSVA) is included in our prices. Foreign road charges will be invoiced to you in addition. In the event of a massive increase in fuel prices, we reserve the right to charge an appropriate surcharge.

4.6 Organisational surcharge

We are happy to make all reservations with other service providers on your behalf for a modest fee of CHF 25.– per reservation.

4.7 Corkage

You can bring your own drinks and food and, of course, use the facilities on our coaches. For this, we charge corkage of CHF 50.– per coach and per order.

4.8 Damage to the coach / cleaning

Wilful damage to the coach will be invoiced at the amount of the repair bill plus an administration fee of CHF 100.–. We will invoice the cost of cleaning heavy soiling (interior) caused by the passengers according to the work involved.

4.9 Second driver / working and rest time regulations (ARV)

For your safety, we comply with the applicable working and rest time regulations for professional drivers. If the ARV cannot be complied with, we will deploy a second driver or a relief driver.

You will find the costs for this in your quote.

Maximum working time: the maximum working time is 15 hours from/to the EUROBUS depot, including coach preparation, cleaning, etc. Please allow for a maximum of 14 hours from/to your boarding point for a driver’s working day. Uninterrupted rest period: 11 hours within 24 hours, in exceptional cases at least 9 hours

Driving breaks: at least 45 minutes after no more than 4.5 hours of driving. Maximum driving time per day: 9 hours (10 hours twice a week). Night journeys with a single driver between 10 pm and 6 am: a maximum of 3 hours of continuous driving

5.

Price increase

EUROBUS may subsequently increase the agreed prices in the following exceptional cases:

a) Subsequent price increases for individual services

b) Newly introduced or increased government charges (e.g. fuel surcharges, VAT rate)

6.

Payment terms

6.1 Advance payment

An advance payment of 100% of the basic service is required for all package bookings. After your event, you will receive a detailed final invoice showing the total balance, less the payments already made. EUROBUS expressly reserves the right to set other payment terms.

6.2 Non-payment or late payment

If EUROBUS does not receive the advance payments on time, EUROBUS is entitled to refuse the services and to withdraw from the contract. Any cancellation costs will be claimed from the customer in accordance with sections 8 or 9 of these terms and conditions.

7.

Complete cancellation of charter journeys (coach service only, without third-party services)

If you have to cancel your trip after placing a definitive order, costs are charged as a percentage of the minimum expected coach revenue, plus any organisational surcharges:

up to 20 days before the start of the trip: CHF 80.–

up to 10 days before the start of the trip: 20%

up to 4 days before the start of the trip: 40%

up to 2 days before the start of the trip: 75%

1 to 0 days before the start of the trip: 100%

8.

Complete cancellation of package offers by the customer

The complete cancellation of your contract must be made in writing (letter or email). All documents already received must be enclosed. The cancellation of your contract only becomes legally valid once all of the above documents have been received in full. The date of cancellation is the date on which your written notification is received by your booking office during normal business hours. If it is received on a Saturday, Sunday or public holiday, the next working day is decisive. In the event of complete cancellation by the customer, and unless otherwise agreed in the quote/order confirmation, EUROBUS will charge the following cancellation costs:

9.1 Half-day or one-day programme: fee of CHF 200.– plus the following cancellation costs:

60–15 days before departure: 10%

14–08 days before departure: 30%

07–02 days before departure: 80%

01–00 days before departure: 100%

9.2 Multi-day programme: fee of CHF 200.– plus the following cancellation costs:

60–22 days before departure: 30%

21–08 days before departure: 50%

07–02 days before departure: 80%

01–00 days before departure: 100%

The cancellation costs are calculated as a percentage of the current total order volume at the time immediately before the complete cancellation. Additional third-party fees will be passed on to the customer.

9.

Partial cancellation of package offers by the customer (change in the number of participants or the programme)

Important: if you make changes, you must inform your booking office in writing. Our travel consultant will confirm the change to you in writing. The date of the change or partial cancellation is the date on which your written notification is received by the booking office during normal business hours. If it is received on a Saturday, Sunday or public holiday, the next working day is decisive.

9.1 Partial cancellation due to a change in the number of participants

The first change in the number of participants up to 15 days before the trip is free of charge, provided that the new number of participants differs by no more than 10% from the number originally confirmed. Increases in the number of participants are possible free of charge at any time, provided that the required capacity (coach size, restaurant, etc.) is available. For each cancelled person, the cancellation costs are charged in accordance with clauses 9.1 and 9.2 of these terms and conditions. The decisive factor for calculating the costs is the average price per person at the time immediately before the cancellation. Additional third-party fees will be passed on to the customer.

9.2 Partial cancellation due to a change in the programme

For a change to the order or programme after confirmation, we charge the following fees: CHF 50.– per change for changes to the programme or date made by the customer. In addition, EUROBUS charges for the cancelled services in accordance with clauses 9.1 and 9.2 of these terms and conditions if the change to the programme or date is notified later than 61 days before the event.

9.3 Failure to attend, late start, no-show or early termination caused by the customer

In these cases, the customer bears the additional costs incurred in addition to the cancellation costs under clause 9. The customer is not entitled to a refund.

10.

Programme changes by EUROBUS

10.1 Before conclusion of the contract

EUROBUS reserves the right to change brochure details, service descriptions and prices before you book. If this is the case, your booking office will inform you of these changes before the contract is concluded.

10.2 After conclusion of the contract

EUROBUS reserves the right to change the travel programme or individual agreed services if unforeseeable or unavoidable circumstances make this necessary. EUROBUS will endeavour to offer you equivalent replacement services and will inform you of such changes as quickly as possible.

10.3 Your rights in the event of a contract change after conclusion of the contract

If the programme change or the change to individual agreed services results in a significant change to an essential element of the contract, or if the price increase exceeds 10% of the package price, you have the following rights:

a) You can accept the contract change.

b) You can withdraw from the contract in writing within 5 days of receiving our notification.

c) EUROBUS will endeavour to provide an alternative service that is as equivalent as possible. If you do not notify us within the above-mentioned period, you are deemed to have accepted the change.

10.4 Your rights in the event of programme changes and service failures during the trip

If a programme change is made during the trip that affects a significant part of the agreed trip, EUROBUS will reimburse you any difference between the agreed price and the actual price of the services provided.

11.

Cancellation by EUROBUS

11.1 Minimum number of participants not reached

If fewer people take part in a trip than the advertised minimum number of participants, the trip may nevertheless go ahead under certain circumstances. In any case, EUROBUS will invoice the minimum number of participants in accordance with the tender or confirmation. However, EUROBUS is entitled to refuse to provide the services for safety, technical or logistical reasons. In this case, the customer is not entitled to a refund and the full price of the trip is payable.

11.2 EUROBUS is entitled to cancel the trip if the customer gives legitimate reason to do so through acts or omissions. Claims for damages are excluded in this case.

11.3 Strikes, force majeure

If the trip or parts of it are jeopardised or made impossible by force majeure, weather and natural conditions, official measures or security risks, EUROBUS may cancel the trip or parts of it or terminate it early. In such a case, EUROBUS will inform you as quickly as possible and will endeavour to offer an alternative service that is as equivalent as possible. Further claims are excluded. If your programme is cancelled in such cases, EUROBUS may invoice the expenses demonstrably incurred.
